Graphic Design Terms and Conditions

The following Terms and Conditions of Service apply to all artwork, graphic design and services provided by Bluefondant.
All design work is carried out by Bluefondant on the understanding that the customer has agreed to abide by Bluefondant’s terms and conditions.
Copyright of all graphic design work is retained by Bluefondant including copy, concepts, ideas, proofs and illustrations (unless specifically released in writing) until after all invoices have been settled.
If multiple design concepts are submitted, only one concept is deemed to be given by Bluefondant as fulfilling the contract. All other artwork designs remain the property of Bluefondant, unless agreed in writing.

Project Acceptance
At the time of proposal, Bluefondant will provide the customer with a written estimate or quotation by post or email as requested.
A copy of the written estimate or quotation is to be signed and dated by the customer to indicate acceptance and should be returned to Bluefondant by email or post. Alternatively, the customer may send an official order in reply to the estimate or quotation which binds the customer to accept Bluefondant’s terms and conditions. No work on a project will commence until either document has been received by Bluefondant.

Design Fees
Fees for design services to be provided by Bluefondant, will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer’s signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% of the quoted fee will become immediately due on projects worth over £500.00. Work on the project will not commence until Bluefondant has received this amount.

Charges for Other Services
Charges for any additional services over and above the estimated design, will be made known to the customer. They will become fully payable at the time of project acceptance.

Payment
The customer will be asked to provide artwork sign off before being issued with an Invoice prior to print/artwork/publication. At this time the remainder of the fees due will become payable. Accounts which remain outstanding for 30 days after the date of invoice, may incur an extra charge with an initial fee of £50, as well as 10% plus the Bank of England base rate per month of the outstanding amount.
Payments may be made by Bacs, cheque, or previously agreed electronic funds transfer.
Returned cheques will incur an additional fee of £50 per returned cheque. Bluefondant reserves the right to consider an account to be in default in the event of a returned cheque.
Please note: Bluefondant understands and will exercise its statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms. Alterations
The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge. These are charge @£4.00 per page for magazines and £15 Per hour for other design work/projects, whichever had been in the original quotation.

Rights of Refusal
Bluefondant will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities. Bluefondant also reserves the right to refuse to include submitted material without giving reason. Any images and/or data that Bluefondant does include in all good faith, and then finds out that it contravenes these Terms and Conditions, the customer is obliged to allow Bluefondant to remove the contravention without hindrance, or penalty. Bluefondant is to be held in no way responsible for any such data being included.

Design Credits
The customer agrees to allow Bluefondant to place a small credit on printed material, exhibition displays, advertisements and/or a link to Bluefondant’s own website on the customer’s website. This will usually be in the form of a small logo or line of text placed towards the bottom of the page.
The customer also agrees to allow Bluefondant to place all designs on Bluefondants own website for portfolio and demonstration purposes and to use any designs in its own publicity unless agreed otherwise.

Design Project Duration
Any indication given by Bluefondant of a design project’s duration is to be considered by the customer to be an estimation. Bluefondant cannot be held responsible for any project over-runs, whatever the cause.

Design Project Completion
Bluefondant considers the design project complete upon receipt of the customer’s sign off. Other services such as printing, display panel production, filmwork, website uploading, publishing etc either contracted on the customers behalf constitute a separate project and can be treated as a separate charge.

Cancellation
Cancellation of orders may be made initially by telephone contact, or email, however, following this, Bluefondant will need formal notification in writing to the company’s postal address. The customer will then be invoiced for all work completed over and above the non-refundable deposit that will have been made at the time of first ordering. The balance of monies due must be paid within 30 days. Please note: any cancellation which is not formally confirmed in writing and received by Bluefondant within 14 days of such instruction being issued, will be liable for the full quoted cost of the project.

Acceptance of Quotation and Terms and Conditions
The placement of an order for design and/or any other services offered by Bluefondant and validated by the customer’s signature on the estimate or quotation, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and Bluefondant.

2.1 Personal Data about our customers is an important part of our business and we shall only use your Personal Data for the following purposes and shall not keep such Personal Data longer than is necessary to fulfil these purposes:
2.1.1 To help us to identify you when you contact us.
We may check your details with fraud prevention agencies. If you provide false or inaccurate information and we suspect fraud, we will record this.
2.2 We will not disclose your Personal Data to any third party except in accordance with this Privacy Policy.
2.3 We need to deliver your cake/design work, this will be when your address details will be used

3.2 We may amend this Privacy Policy from time to time without notice to you, in which case, we will publish the amended version on the Website. You confirm that we shall not be liable to you or any third party for any change to this Privacy Policy from time to time. This Privacy Policy applies to Personal Data we hold about individuals. It does not apply to information we hold about companies and other organisations.

Flavours

I use delicious flavours including Vanilla, Chocolate and Fruit. If there is a particular flavour you are looking for let me know and I’ll see if I can incorporate it into your cake.

Edible Dusts

Coverings

Wedding cakes are covered in marzipan and sugar-paste, but can be made without marzipan if you prefer.

Design Service

Choose from any of my cake designs seen on my site or come armed with ideas, inspiration material, including colour swatches/patterns to come up with something spectacular. Or I can help you tweak designs to fit your theme, changing the colour or switch different design elements around.For Wedding cake designs come armed with colour swatches, dress designs/fabrics, flower info, patterns, pictures anything to help me get a feel for your special day. this will allow me to create something perfect for your special day.

Allergies & Dietary Requirements

Nuts!

Please be aware that I do have nuts in my fruit cake recipe and that means that there are nuts in my kitchen! Albeit that I do my best to make sure that I don’t cross contaminate ingredients, I cannot guarantee there will be no nuts. Please note that I cannot guarantee that ingredients that I use have not been contaminated at source. Wedding cakes are covered in Marzipan and icing but if you let me know I can of course not use marzipan.

Gluten free

Choose from fruitcake, sponge cake as gluten free options – please check with me for other flavours.

But please note that I do have flour in my kitchen that contains gluten. Whilst I do my best no to cross contaminate, if you are hyper sensitive then I cannot guarantee completely gluten free!

Vegan

I have a fab vegan recipe for fruit cake thats divine!

Alcohol

I use alcohol in the process of decorating cakes and also some recipes include alcohol but I can substitute these if need be. Just let me know at the time of ordering the cake.

Payments

Deposits are non-refundable. All wedding cake orders require a non-refundable deposit of 50% of the total cost to book the date but not less than £100. In the event that any payment is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. Please note that all deposits are non-refundable and non-transferable unless agreed 30 days before the event the cake is needed for by both parties in writing by either email or post. All deposits become due when the order has been placed and details checked and agreed by you. All orders are deemed to have been accepted only when the deposit has been paid.Bluefondant accepts no responsibility for any loss how so ever caused or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure. Late payment fees – £5.00 per day – will be applied and if the final balance has not been paid within the agreed time limit the booking will be deemed to have been cancelled. Full payment must be received 14 days prior to delivery/collection. Payments may be made by Bacs, cheque, or previously agreed electronic funds transfer.Returned cheques will incur an additional fee of £50 per returned cheque. All my cakes are packaged carefully for delivery or collection. They can be collected from me directly or they can be delivered free to venues within Billericay. I can deliver outside this area. If you require me to set up your cake at the venue please bring the details with you at the time or ordering there is an additional charge for this.Once cake orders are collected, the full responsibility for its safety is with you and Bluefondant are not responsible for any damage to your cake once it has left the premises. I will ensure your cake is secure and well packaged and provide you with full instructions for any assembly (most come completely assembled and ready to be placed straight onto your cake table) and storage but I can’t guarantee the state of the roads or the quality of the driver!Wedding InsuranceUnfortunately the possibility also arises that I may be unable to deliver your cake due to unforeseen circumstances like adverse or freak weather conditions that may make your venue inaccessible. Also severe traffic problems can arise occasionally. I strongly recommend that you purchase wedding insurance to cover yourself for this possible eventuality. I took this out for my own wedding! Its peace of mind at the end of the day.
